Agreement to Terms
By accessing or using RunTree ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
Description of Service
RunTree is a web-based platform that provides:
- Integration with Strava to sync and display your running activities
- Public profile pages showcasing your running achievements
- AI-powered weekly coaching insights and training recommendations
- Race tracking and performance analytics
- Profile customization and theme options
- Email delivery of weekly coaching reports
Account Registration
Account Requirements
- You must be at least 13 years old to use RunTree
- You must provide accurate and complete information during registration
- You must authenticate using Google OAuth
- You are responsible for maintaining the security of your account
- You must not share your account credentials with others
Profile Handle
Your profile handle (username) must be unique and appropriate. We reserve the right to reclaim handles that are inactive, offensive, or infringe on trademarks.
User Obligations
Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Violate or infringe on the rights of others, including privacy and intellectual property rights
- Upload false, misleading, or fraudulent information
- Harass, abuse, or harm other users
- Attempt to gain unauthorized access to the Service or its systems
- Use automated scripts or bots to scrape data or access the Service
- Reverse engineer, decompile, or attempt to extract source code
- Transmit viruses, malware, or any harmful code
- Interfere with or disrupt the Service or servers
Content Standards
Any content you upload (profile information, race photos, bio) must comply with our content standards. Content must not be offensive, defamatory, illegal, or violate third-party rights.
Strava Integration
- You authorize us to access your Strava data as permitted by Strava's OAuth flow
- We will sync your running activities automatically and store them in our database
- You can disconnect Strava at any time through your account settings
- You are responsible for ensuring your Strava account complies with Strava's Terms of Service
- We are not responsible for changes to Strava's API or service interruptions
AI Coaching
Our AI coaching feature provides personalized training insights generated by OpenAI GPT-4o-mini:
- AI coaching is for informational and educational purposes only
- AI-generated advice is not a substitute for professional coaching or medical guidance
- We do not guarantee the accuracy or effectiveness of AI recommendations
- You use AI coaching insights at your own risk
- Always consult qualified professionals for health and training decisions
Subscriptions and Payments
Premium Features
Some features may require a paid subscription managed through Polar.sh:
- Subscription fees are billed according to your selected plan
- All fees are non-refundable except as required by law
- We reserve the right to change pricing with 30 days notice
- You can cancel your subscription at any time through your account settings
- Cancellation takes effect at the end of your current billing period
- We may suspend or terminate access for non-payment
Free Features
Certain features remain free. We reserve the right to modify, limit, or discontinue free features at any time.
Public Profiles
Your profile page (runtree.com/[your-handle]) is publicly accessible by default. By using the Service, you consent to your profile information, activities, and race results being publicly displayed. You can customize what appears on your profile through customization settings.
Intellectual Property
Our Rights
All content, features, and functionality of RunTree (including but not limited to design, text, graphics, logos, code, and software) are owned by RunTree and protected by copyright, trademark, and other intellectual property laws.
Your Content
You retain ownership of content you upload. By uploading content, you grant us:
- A worldwide, non-exclusive, royalty-free license to use, display, and distribute your content
- The right to process your content for AI analysis and coaching insights
- The right to display your content on your public profile page
This license ends when you delete your content or account, except for content that has been shared publicly.
Service Availability
- We strive to provide uninterrupted service but do not guarantee 100% uptime
- We may suspend the Service for maintenance, updates, or technical issues
- We are not liable for service interruptions or data loss
- Third-party service outages (Strava, OpenAI, etc.) may affect functionality
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Accuracy, reliability, or completeness of any content or data
- Uninterrupted, secure, or error-free operation
- Results from using the Service, including AI coaching recommendations
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUNTREE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Injury or harm resulting from use of AI coaching advice
- Unauthorized access to or alteration of your data
- Third-party conduct or content
- Service interruptions or technical failures
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
Indemnification
You agree to indemnify and hold harmless RunTree from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any rights of others, or (d) content you upload.
Termination
By You
You may terminate your account at any time through your account settings. Upon termination, your data will be deleted within 30 days.
By Us
We may suspend or terminate your account immediately if:
- You violate these Terms
- You engage in fraudulent or illegal activity
- Your account remains inactive for an extended period
- We are required to do so by law
- We discontinue the Service
Upon termination, your right to use the Service ceases immediately. Provisions that should reasonably survive termination (liability, indemnification, dispute resolution) will remain in effect.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
Dispute Resolution
Informal Resolution
Before filing a claim, you agree to contact us at contact@runtr.ee to attempt informal resolution. We will attempt to resolve disputes in good faith.
Binding Arbitration
Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except as required by law.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and RunTree regarding the Service and supersede all prior agreements.
